Heart of Cape Cod – Beach Gear Rental Agreement

By checking the box and signing below, the Renter agrees to the following terms and conditions regarding the rental of beach gear (chairs, umbrellas, cabanas, etc.) from Heart of Cape Cod (HOCC):

1. Rental Period & Return Times

• Rental Period: begins on the first day and ends at 10:00 AM on the final day unless otherwise specified.
• Deadline: All rental periods end on the specified return date.
• Time: All gear must be returned (for non-guests) or ready for pickup (for HOCC guests) by 10:00 AM on the return date.
• Late Fee: Items not ready or returned by 10:00 AM are subject to a $25.00 Late Fee.

2. Pickup & Delivery Protocol

• HOCC Guests: Gear will be delivered to the property listed on your reservation and picked up by our team.
• Non-Guests (General Public): You are responsible for picking up and dropping off gear at our office: 50 Brackett Rd, N Eastham, MA 02651.
  • Office Hours: 9:00 AM – 5:00 PM.
  • Fees: A $15.00 Processing Fee applies to all pickup orders. A $30.00 Rush Fee is added to any same-day orders.

3. Equipment Care & Cleaning

• Condition: Gear must be returned in the same condition in which it was received. Please remove personal items, shake off loose sand, and ensure equipment is dry before return.
• Cleaning Fee: A $25.00 Cleaning Fee will be charged for any items returned dirty, stained, or excessively sandy.

4. Damage, Loss & Liability

• Responsibility: The Renter assumes full responsibility for the equipment during the rental period. The Renter agrees to pay the full replacement cost for any lost, stolen, or damaged items.
• Liability: Heart of Cape Cod is not responsible for any accidents or injuries resulting from the use or misuse of the rental equipment (e.g., umbrella handling, pinching fingers in chairs).

5. Payment & Charges

• The Renter authorizes Heart of Cape Cod to charge the credit card on file for any applicable late fees, cleaning fees, or replacement costs as outlined above.

6. Cancellations

• Full refund for cancellations made by 4:00 PM EST 24 hours prior to the start of rental. No refunds after that. No-shows for pickup will be charged the full rental price.
